1. OUR SERVICES
The information and tools provided when using the Services are not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction.
The Services are not tailored to comply with industry-specific regulations (such as HIPAA, FISMA, or GLBA). If your activities require compliance with such frameworks, you may not use the Services.
2. INTELLECTUAL PROPERTY RIGHTS
We are the owner or the licensee of all intellectual property rights in our Services, including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").
Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services solely for your internal business or personal use.
3. USER REPRESENTATIONS
By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have legal capacity and agree to comply with these Legal Terms; (4) you are not a minor; (5) you will not access the Services through automated or non-human means; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use will not violate any applicable law or regulation.
4. USER REGISTRATION
You agree to keep your account credentials confidential and remain fully responsible for all activity conducted through your account. We reserve the right to remove, reclaim, or change a username you select if we determine it to be inappropriate or offensive.
5. PURCHASES AND PAYMENT
We accept major credit cards including Visa, Mastercard, American Express, and Discover. You agree to provide current, complete, and accurate purchase and account details for all transactions. All payments are billed in US Dollars.
6. SUBSCRIPTIONS AND REFUND POLICY
Recurring Billing: Subscription plans automatically renew at the end of each billing interval unless canceled prior to the renewal date. You authorize us to charge your payment method on file for the agreed recurring amount.
Lifetime Deals (LTD): Any "Lifetime" plan or purchase refers specifically to the active lifetime of the QR Star product and its continued operation by Profecio LLC, not the lifetime of the purchaser.
Refund Policy: Except as explicitly governed by third-party marketplace guarantees (such as AppSumo's 60-day refund policy, which must be processed directly through their platform), standard direct purchases on our platform are non-refundable.
No Refunds on Policy Violations: Under no circumstances will refunds, prorated credits, or fee returns be issued to any user whose account is terminated due to spam, phishing, abusive routing, or blacklisting violations under Section 7.
7. ACCEPTABLE USE & STRICT ANTI-SPAM POLICY
QR Star provides mission-critical dynamic QR routing infrastructure. To safeguard our shared routing domains, IP reputations, and customer delivery standards, we enforce an absolute Zero-Tolerance Policy against abusive, deceptive, and harmful traffic.
Notice of Immediate Termination & Blacklist Protection:
You are strictly prohibited from generating QR codes that link directly or indirectly to:
- Unsolicited commercial email campaigns, bulk SMS spam, or unauthorized messaging;
- Phishing pages, credential-harvesting mechanisms, or deceptive identity spoofing;
- Employing "bait-and-switch" tactics, such as initially pointing a dynamic QR code to a benign destination to pass security checks, and later modifying it to route to prohibited, malicious, or spam-related content;
- Malware, ransomware, Trojan horses, rootkits, spyware, or malicious executables;
- Scams, fraudulent offers, pirated media, or illicit/unlawful goods;
- Any destination URL that causes, or risks causing, QR Star domains or routing IPs to be flagged or blacklisted by Google Safe Browsing, Spamhaus, SURBL, Cloudflare, antivirus vendors, or similar threat intelligence databases.
Immediate Forfeiture: If we detect or receive verified abuse complaints concerning your codes, QR Star reserves the absolute right to immediately disable your QR codes, suspend or terminate your account without notice, and retain 100% of all fees paid with NO REFUND.
8. PROHIBITED ACTIVITIES
You may not access or use the Services for any purpose other than that for which we make them available. As a user of the Services, you agree not to:
- Systematically scrape or collect data or directory listings from the Services without written permission from us.
- Circumvent, disable, or interfere with security features of the Services or features that enforce usage limitations.
- Engage in unauthorized framing of or linking to the Services.
- Upload or transmit viruses, Trojan horses, automated bots, or continuous posting mechanisms that degrade our routing speed.
- Reverse engineer, decompile, or disassemble any part of the software making up the Services.
- Use the platform to harass, abuse, defraud, or impersonate other users or entities.
- Resell, rent, or transfer your user credentials or dashboard access without our authorization.
9. USER GENERATED CONTRIBUTIONS
When you create QR codes, metadata, titles, or associated digital assets ("Contributions"), you warrant that your content does not infringe the intellectual property rights of any third party, is not unlawful or defamatory, and does not violate any applicable advertising or consumer protection statutes.
10. CONTRIBUTION LICENSE
You retain full ownership of your data and destination content. You grant QR Star a worldwide, royalty-free license solely to route, cache, and transmit your data as required to operate the dynamic scan services.
11. SOCIAL MEDIA
If you connect third-party social accounts to our Services, you represent that you are authorized to disclose your account connection details to us without violating third-party terms of service.
12. THIRD-PARTY SERVICES & ATTRIBUTION
The Services incorporate third-party data providers, payment gateways, and geolocation databases to power scan routing and analytics. We are not responsible for third-party destination websites linked via user-created QR codes.
Data Attribution Notice: This product includes GeoLite2 data created by MaxMind, available from https://www.maxmind.com.
13. SERVICES MANAGEMENT
We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these terms; (3) disable or delete burdensome or abusive QR targets; and (4) manage the infrastructure to ensure uninterrupted uptime for all lawful customers.
14. PRIVACY POLICY & SCAN ANALYTICS
We take digital privacy seriously. When end users scan a QR Star dynamic code, our infrastructure processes the scan request to extract non-identifying country and city analytics. Raw IP addresses are mathematically anonymized using cryptographic one-way hashes (HMAC-SHA256) and are never stored in plain text. Please review our full Privacy Policy.
15. TERM AND TERMINATION
These Legal Terms remain in full effect while you use our Services. WITHOUT LIMITING ANY OTHER PROVISION, WE RESERVE THE RIGHT TO TERMINATE YOUR ACCESS (INCLUDING BLOCKING SPECIFIC IP ADDRESSES OR DEACTIVATING SPECIFIC QR CODES) AT ANY TIME, WITHOUT NOTICE OR LIABILITY, FOR ANY VIOLATION OF THESE TERMS, INCLUDING OUR ANTI-SPAM POLICY.
16. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to modify or discontinue the Services at our discretion. We are not liable for any downtime, technical interruptions, or maintenance windows that may temporarily affect routing.
17. GOVERNING LAW
These Legal Terms and your use of the Services are governed by the laws of the State of California, without regard to conflict of law principles.
18. DISPUTE RESOLUTION
Any dispute, controversy, or claim arising out of or relating to these Legal Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Los Angeles, California. You agree to resolve all disputes individually and waive any right to participate in a class action lawsuit.
19. CORRECTIONS
We reserve the right to correct typographical errors, pricing inaccuracies, or omissions on the Site at any time without prior notice.
20. DISCLAIMER
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
21. LIMITATIONS OF LIABILITY
IN NO EVENT SHALL PROFECIO, LLC, OR ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRECEDING THE CLAIM.
22. INDEMNIFICATION & BLACKLIST DAMAGES
You agree to defend, indemnify, and hold harmless Profecio, LLC, QR Star, and our officers, employees, and agents from and against any loss, damage, liability, regulatory fine, claim, or demand (including reasonable legal fees) resulting from: (1) your use of the Services; (2) your breach of these Legal Terms; (3) any spam, malware, or illicit content associated with your destination URLs; or (4) any incident where your QR targets cause our domains, IP addresses, or routing servers to be blacklisted, penalized, or flagged by security authorities.
23. USER DATA
While we perform regular automated backups, you are solely responsible for maintaining backup records of your QR configurations and target assets.
24. ELECTRONIC COMMUNICATIONS & SIGNATURES
You consent to receive communications from us electronically and agree that digital confirmations, invoices, and notices satisfy all legal requirements for written communication.
25. CALIFORNIA USERS AND RESIDENTS
California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by writing to 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210.
